The Alabama State Bar is not able to not provide or sell mailing lists for firm announcements, general solicitations, sales pitches for products or services not sponsored by the Bar, or political campaigns by members or non-members for a political office that does not require membership in the Alabama State Bar. A list of all attorneys in Alabama, and/or their contact information is not covered in Alabama’s Open Records Act.

In addition, the Alabama Open Records Act records requests only apply to Alabama citizens requesting approved public records. See Ala. Code §36-12-40 (1975); McBurney v. Young, 133 S. Ct. 1709 (2013).

Any records requests seeking mailing lists for marketing purposes will be denied.

 

 

 

 

Alabama State Bar Policy Governing the Production of Public Records

Alabama law makes public records available to its citizens, subject to exceptions specified by law (sections 36-12-40 and 41, Code of Alabama, 1975, as amended). These exceptions generally prevent the disclosure of privileged and confidential information. Responses to records requests are made by the Alabama State Bar employees who have other primary duties. Therefore, in the interest of efficiency and good stewardship of taxpayer funds, the following procedure has been established to provide an orderly method for requesting and viewing records that are held or maintained by the Alabama State Bar.
